Author Terms
Last updated: September 2026
These Author Terms of Service govern selling books on gimmebook. gimmebook is operated by Tiny Worlds, LLC. By creating an author account, you agree to them. Buying a book is covered by the Reader Terms instead, which are a separate document.
1. ACCOUNTS AND ELIGIBILITY
You must be at least 18 years old and legally able to enter a contract in your jurisdiction. You are responsible for keeping your password secure and for all activity under your account. Notify support immediately if you suspect unauthorized access.
2. AUTHOR RESPONSIBILITIES
As an author you represent and warrant that you own or have all necessary rights to the content you upload, that it does not infringe the intellectual property, privacy, or other rights of any third party, and that it complies with applicable law.
You also confirm that you hold the rights needed to grant the license in Section 3 (which lets us sell and promote your book), including for cover artwork you licensed from a designer or a stock vendor. Some artwork licenses allow the artwork to be used for the book itself but not to advertise anything else, and checking that before you upload is your responsibility. If you cannot grant those rights for a particular book, tell support and we will limit how that book is used.
3. LICENSE TO USE YOUR WORK
Your work stays yours. gimmebook claims no ownership of anything you upload: you keep all copyright and other rights in your books, covers, descriptions and profile. What you grant us below are licenses, nothing more.
First, the books themselves. So that we can sell and deliver them, you grant gimmebook a non-exclusive, worldwide, royalty-free license to:
- store your book files and keep backups of them,
- make the technical copies and format conversions that delivery requires,
- transmit copies to customers who buy the book and grant them the personal-use rights described in the Reader Terms, and
- open and review a file to check it complies with these Terms.
We may exercise this license through the service providers that host and run gimmebook for us, for these same purposes only. This part of the license exists only to run the service. It continues after a book is unpublished or an account is closed for as long as we need it to deliver to customers who already bought the book, to handle refunds and disputes, and to keep the records the law requires.
Second, to run your store and to promote gimmebook and the books sold on it, you grant gimmebook a non-exclusive, worldwide, royalty-free license to reproduce and display your book covers, titles, book descriptions, author name, author bio and author photograph. That covers both:
- Running the service: your gimmebook author page and book pages, checkout, order confirmations, receipts and delivery emails, the preview card that appears when a gimmebook link is shared elsewhere, and search and sitemap output.
- Promoting gimmebook and the books sold on it: our own website, emails and newsletters, social media accounts, press and partner material, and advertising.
We use this to feature authors and the books they sell here. We may resize or crop covers and reformat titles and descriptions to fit different surfaces; we do not materially alter your work. We do not sell or license your work on to third parties for their own advertising.
This second part of the license lasts as long as your books are listed with us. If you unpublish a book or close your account we stop promoting your work going forward, though material already printed, already sent in an email, or posted on a platform we do not control may remain in circulation. The running-the-service uses continue for as long as the first part of the license does, so a customer who already bought your book can still get receipts, delivery emails and replacement download links. If you want us to stop featuring a particular book or your photograph before then, contact support.
4. PROHIBITED CONTENT
You may not upload or sell content that:
- Infringes copyright, trademark, or other intellectual property rights you do not hold or are not licensed to use.
- Depicts minors in sexual, suggestive, or exploitative contexts, including child sexual abuse material (CSAM) of any kind, whether real or synthetic. Violations result in immediate account suspension and will be referred to the National Center for Missing and Exploited Children (NCMEC) and law enforcement as required by law.
- Is non-consensual intimate imagery or content created to harass, threaten, or defame a real person.
- Incites violence, promotes terrorism, or facilitates illegal activity.
- Contains malware or is designed to compromise user devices.
5. COPYRIGHT INFRINGEMENT (DMCA)
If you believe content on gimmebook violates your copyright, send a DMCA notice to dmca@gimmebook.com that includes (a) your contact information, (b) a description of the copyrighted work, (c) the URL of the infringing material, (d) a statement that you have a good-faith belief the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner, and (f) your physical or electronic signature. We will review valid notices and remove infringing content.
6. ADMIN REVIEW AND COMPLIANCE MONITORING
You acknowledge that gimmebook administrators may download and review any published book at any time to confirm compliance with these Terms, applicable law, or payment-processor requirements. Listing a book means accepting this review.
7. SUSPENSION AND TERMINATION
We may suspend or terminate your account, remove content, withhold payouts, or cooperate with law enforcement if we believe in good faith that you have violated these Terms, engaged in fraud, misrepresented your identity or ownership of content, or caused harm to users of the service. Where practical we will notify you, but some violations (such as CSAM or active fraud) require immediate action without prior notice.
A suspension is not always total. We can restrict parts of an account independently: signing in and dashboard access, whether your store and book pages are visible, whether new purchases can be made, and whether we keep recording page views for your pages. That lets us stop a specific problem without taking down everything else, and it lets us leave you able to sign in and correct a listing where that is the appropriate response. Customers who have already bought a book keep the download access described in the Reader Terms.
If we withhold payouts, we withhold what relates to the problem: the sales at issue and what we may need to cover refunds or chargebacks arising from it. The rest pays out normally, and withheld amounts are paid out or refunded to customers once the matter is resolved.
8. WHERE WE SELL
gimmebook does not sell in every country. Whether a purchase can go through is determined at checkout: buyers in countries we do not yet serve are offered a waitlist instead of a purchase. We add countries as tax, consumer protection and content rules allow. Authors may sign up and list books from anywhere, and anyone may browse.
9. PAYMENTS, FEES, AND REFUNDS
Your price and estimated payout and fee rates are shown in your dashboard. Processing rates and fees vary by transaction and change over time, so the dashboard shows the actual amounts for each completed sale. Payment processing is handled by a third-party payment processor, and payouts are subject to the processor’s terms. Earnings from a sale become payable once that order’s refund window has closed. Payable earnings are transferred to your payout account once they reach a minimum payout threshold, currently $20; until then they accumulate in your balance and remain yours. We may change the threshold amount for future payouts, and we may release a balance below it on request or at our discretion. If your account is closed, any remaining payable balance is transferred to your payout account before the closure completes, regardless of the threshold. A customer may request a refund while their order is still inside its refund window and the book has not been downloaded. The length of that window is fixed when the order is placed and does not change afterwards, even if we later change the standard window for new orders. The order stays refundable until its window has run out or the file has been downloaded (a download counts once it completes), whichever happens first. Refunds required by consumer law based on where the customer lives can fall outside this rule.
10. TAXES ON PAYOUTS
Payouts made to authors through the service (your royalties) represent income to the author. Authors are solely responsible for determining and fulfilling their own tax obligations arising from payouts received, including income tax, self-employment tax, VAT, GST, or any other taxes applicable in their jurisdiction. gimmebook does not withhold taxes from payouts except where required by law. Authors who are US persons may receive a Form 1099 where required by applicable IRS reporting thresholds. gimmebook makes no representation as to the tax treatment of this income in any jurisdiction and recommends that authors consult a qualified tax advisor regarding their obligations.
11. DATA RETENTION AND USE
We keep four kinds of records:
- Payment information, which is retained by our payment processor under their terms.
- Payout-account identifiers and status, which the payment processor is legally required to collect from authors and shares with us so we can route earnings.
- Email addresses and order records, kept for order history, support, and the tax and accounting records we are required to hold.
- Data about how gimmebook is used, collected so that we can keep improving it.
What we collect and how we use it is set out in the Privacy Policy.
Automated account and data deletion is available. Authors can request deletion from their account settings, and the request is carried out automatically after a grace period during which it can be cancelled. Customers can request deletion or a copy of their data through support; once a request is confirmed, the deletion itself runs automatically. Some records survive a deletion request where the law requires it, such as the transaction record behind a completed sale, which is kept both in our accounting records and by our payment processor.
12. INDEMNITY
You agree to indemnify and hold harmless Tiny Worlds, LLC, its officers, employees, and affiliates from any claim arising from content you upload, intellectual-property infringement, violation of applicable law, or misuse of the platform.
13. DISCLAIMERS AND LIMITATION OF LIABILITY
gimmebook is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Tiny Worlds, LLC disclaims all implied warranties and is not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
14. CHANGES
We may update these Terms. The current version is always available on gimmebook, and the date at the top shows when it last changed. Continued use of gimmebook after an update constitutes acceptance.
