These Terms of Service govern your use of gimmebook. By creating an account or purchasing a book, you agree to these Terms.
1. ACCOUNTS AND ELIGIBILITY
You must be at least 18 years old and legally able to enter a contract in your jurisdiction. You are responsible for keeping your password secure and for all activity under your account. Notify support immediately if you suspect unauthorized access.
2. AUTHOR RESPONSIBILITIES
As an author you represent and warrant that you own or have all necessary rights to the content you upload, that it does not infringe the intellectual property, privacy, or other rights of any third party, and that it complies with applicable law.
3. PROHIBITED CONTENT
You may not upload or sell content that:
- Infringes copyright, trademark, or other intellectual property rights you do not hold or are not licensed to use.
- Depicts minors in sexual, suggestive, or exploitative contexts, including child sexual abuse material (CSAM) of any kind, whether real or synthetic. Violations result in immediate account suspension and will be referred to the National Center for Missing and Exploited Children (NCMEC) and law enforcement as required by law.
- Is non-consensual intimate imagery or content created to harass, threaten, or defame a real person.
- Incites violence, promotes terrorism, or facilitates illegal activity.
- Contains malware or is designed to compromise user devices.
4. COPYRIGHT INFRINGEMENT (DMCA)
If you believe content on gimmebook violates your copyright, contact support with a DMCA notice that includes (a) your contact information, (b) a description of the copyrighted work, (c) the URL of the infringing material, (d) a statement that you have a good-faith belief the use is not authorized, and (e) a statement under penalty of perjury that the information is accurate and you are authorized to act on behalf of the copyright owner. We will review valid notices and remove infringing content.
5. ADMIN REVIEW AND COMPLIANCE MONITORING
You acknowledge that gimmebook administrators may download and review any published book at any time to confirm compliance with these Terms, applicable law, or payment-processor requirements. This review is a condition of listing your content on the platform.
6. SUSPENSION AND TERMINATION
We may suspend or terminate your account, remove content, withhold payouts, or cooperate with law enforcement if we believe in good faith that you have violated these Terms, engaged in fraud, misrepresented your identity or ownership of content, or caused harm to users of the platform. Where practical we will notify you, but some violations (such as CSAM or active fraud) require immediate action without prior notice.
7. GEOFENCING
gimmebook currently serves U.S. customers only. Purchases originating outside the United States and its territories may be blocked at checkout. We are working to expand internationally; availability outside the U.S. is subject to applicable tax, consumer protection, and content regulations in your jurisdiction.
8. PAYMENTS, FEES, AND REFUNDS
Price, payout split, and fee rates are shown in your dashboard at the time of sale. Payment processing is handled by a third-party payment processor, and payouts are subject to the processor's terms. Customers may request a refund within 7 days of purchase, provided the book has not been downloaded. Refunds are final.
9. DATA RETENTION
Payment information is retained by our payment processor per their terms. Email addresses and order records are retained for order history and support purposes. Analytics data is retained for 90 days. Full automated account and data deletion is not currently available; contact support with questions about data retention. See our Privacy Policy for details.
10. INDEMNITY
You agree to indemnify and hold harmless Tiny Worlds, LLC, its officers, employees, and affiliates from any claim arising from content you upload, intellectual-property infringement, violation of applicable law, or misuse of the platform.
11. DISCLAIMERS AND LIMITATION OF LIABILITY
gimmebook is provided "as is," without warranties of any kind. To the fullest extent permitted by law, Tiny Worlds, LLC disclaims all implied warranties and is not liable for any indirect, incidental, or consequential damages arising from your use of the platform.
12. CHANGES
We may update these Terms from time to time. Material changes will be reflected by bumping the version. Continued use of gimmebook after an update constitutes acceptance.
